The Oxfam International Secretariat is currently headquartered in Nairobi, with offices in Oxford, Washington DC, New York, Brussels, Geneva, and a liaison office with the Africa Union in Addis Ababa.
The purpose of the Shared Legal Service is to provide an effective and efficient legal service to Oxfam International, to support the work of its Affiliate members, and to use the law to achieve Oxfam’s purposesJob Purpose-Key Responsibilities and AccountabilitiesThis role reports to the General Counsel, who is based in Oxford, and who reports to the Chief Operating Officer.
The General Counsel is on the (extended) Oxfam International Management Team, and also reports to the Chief Executive and to the Chair of the Board of Supervisors as required.The General Counsel is also General Counsel of Oxfam GB.
The role of the General Counsel and the Legal Counsel is to support the legal management of the Oxfam International Secretariat, to coordinate a legal response to issues that apply across the Oxfam Confederation, and to support the Affiliate members of Oxfam International in relation to legal risk.
The General Counsel is the Director of the Shared Legal Service, which is an informal network of the Legal Advisers employed in the Oxfam Confederation. Currently there are 3.5 Legal Counsel (including the Oxfam International General Counsel) and the Legal Team Administrator in Oxfam GB, 1.5 in Oxfam Spain, I in Oxfam Netherlands, and 2 Full Time Equivalent in Australia.In Oxfam International responsibility for the delivery of country programmes is shared between Oxfam International (which provides the line management and direction), Executing Affiliates (who provide back office services and support to country programmes, with one Executing Affiliate per country), and Partner Affiliates (which includes the Executing Affiliates), who have a particular focus on support to countries.
The Shared Legal Service members also participate actively in legal networks, including the INGO legal network, and manage Oxfam’s legal pro bono relationships.
Geographical scopeThis role supports the global work of Oxfam International, but has a particular focus on Africa.
As the Oxfam International Secretariat has its headquarters in Nairobi, where the Chief Executive is based. Contract support:
To draft, negotiate and help manage contracts including procurement, donor contracts,partner agreements,property, intellectual propertyand consultancy contracts for Oxfam International Secretariat, and for country and regional programmes, in particular but not limited to in Africa.Risk management and compliance
To work with the Oxfam International Risk and Assurance Group to provide legal input into the Confederation’s risk management processes, and will maintain an overview of and communicate relevant legal developments in Africa to colleagues.
To assist with training on legal issues.To review Oxfam’s Quarterly Management Report and annual reporting from countries and regions, to identify legal issues and help resolve them.
To support investigations, including in relation to fraud, aid diversion, and, if suitably trained, safeguarding.
To monitor trends in the space for civic society in Africa, and its potential impact on Oxfam.
To support the implementation of data privacy rules across the Confederation, and the development and implementation of Binding Corporate Rules.Coordination of Shared Legal
Service
To support the General Counsel in the coordination of the Shared Legal Service, with input from the Legal Team Administrator.
To help produce the agenda and to provide minutes of the Shared Legal Service meetings.To continue to develop the Intranet (Compass) legal pages with useful templates and guidance, building on the Oxfam legal toolkit (How to do everything....legally).
To maintain the Legal Contacts database.To support the legal aspects of the ongoing harmonization of Confederation policies, procedures, contracts and guidance notes, particularly in relation to our donor requirements.
To provide input as required into country and regional programmes, particularly in Africa, on employment and taxation issues, working with HR colleagues.Campaigning and advocacy/Human rights
To support Oxfam’s campaigning and advocacy work, in particular with support on the risk management of the work in Africa.
To participate subject to the direction of the General Counsel in the proactive use of the law to achieve Oxfam’s goals, in particular with work on human rights and with members of the legal community in East Africa.Litigation To develop and maintain Oxfam’s International Litigation Register, and liaise with relevant insurance leads across the Confederation.
To liaise with local counsel to support the conduct of litigation in Africa.Governance support
To support the Oxfam Head of Governance in tandem with the General Counsel in legal inputs to Confederation governance issues, including supporting the development of policies and standard operating procedures.
This will become more important in 2019 as we move into strategic planning for the next 6 years, and a governance review.Other
To provide additional legal support as required by Oxfam and as directed by the General Counsel.
As the role is based in the Oxfam International Headquarters, it is likely that the role will also need to provide support to members of the Oxfam International Management Team on an ad hoc basis, including the Chief Executive.
Technical Skills, Experience & Knowledge Essential
University degree (or equivalent) in law, and admitted to practice law
Experience of providing legal advice in relation to the laws of several countries
Experience in contract law drafting, negotiation and management
Good communication skills, ability to explain legal concepts in a simple way
Experience in risk management
Understanding of regulatory environment
Proven ability to engage a diverse range of audiences
Desirable
Effective negotiation abilities and informal leadership in a globally distributed multi- stakeholder environment
Employment and tax law experienceExperience in remote working in a multi-locational team
Interest in and experience of campaigning and advocacy/human rights
Understanding of issues facing civil society
Demonstrable project management skills
Litigation experience
Experience of data privacy issues
Fluent spoken French, ability to read legal French
