Description
Our client is a well established Insurance Company in Kenya. They wish to recruit an experienced Legal Manager for their Legal Department at the Head Office in Nairobi.
Purpose of Position
To provide legal services to the Company and ensure the Company’s interest are protected.
To provide effective management of legal contractual risks arising from insurance claims and ensure the Company operates within the applicable legal and regulatory frameworks.
To provide a proper and proactive management of all legal claims by ensuring prompt settlement at optimal cost in order to achieve high levels of customer satisfaction and cost cutting for the Company.
Responsibility and Authority
General Legal Duties
Providing proactive and pragmatic advice to the business on all legal and regulatory matters
Provide legal representation to the Company, formulate and manage corporate strategies and initiatives for all legal aspects of the Company
Manage legal risk within the business by taking responsibility for providing legal advice to the business on all legal matters affecting their individual departmental transactions
Managing litigations affecting the Company
Reviewing and providing advice to the business upon request on matters concerning applicable contracts required for operation of the business
Set the strategy and goals for the legal team in alignment with the larger organizational goals
Supervise legal staff and oversee a department that can appropriately support the business
Overseeing all legal matters, including managing external legal counsel and providing regulatory liaison
Providing daily interaction and advice to the departmental heads on all aspects of the Company’s business
Advice management on a variety of administrative labour and employment law matters, including engagements and terminations
Legal Claims
Receiving court summonses and determining whether liability attaches on the part of the Company
Appointing, supervising and managing of advocates in the Company’s panel to file defence or sue on their behalf
Attending court and filing defences and other court process and attending court to defend cases
Maintaining a register for appointed advocates
Maintaining a register for judgements
Instructing the Company’s advocates on whether the suits in court should proceed for trial or they should be negotiated out of court to avoid escalation of costs on confirmed injuries
Negotiating out of court settlements
Negotiating with third party advocates in cases where the Company has not appointed advocates
Perusing through and acting on correspondence and opinions from the Company’s advocates within deadlines
Recommending settlements for judgements, advocates’ and other service providers’ fees
Assist in processing of payments to claimants and services providers
Confirming accuracy of fee notes raised by the Company’s advocates in accordance with the Advocates Remuneration Order and ensuring prompt payment
Perusing through and acting on any correspondence and/or enquiries regarding legal claims within deadlines
Conducting legal research and preparing legal options on liability and quantum/review such opinions once they are received by the Company’s advocates
Organizing for witnesses to attend court and the Company’s advocates’ offices for pre-trial briefing
Maintaining a master diary of court cases facilitating hearings of court cases to ensure timely conclusion
Attending
court as a Company representative/witness
Review investigation reports, to ensure that they are comprehensive enough to meet the need for which they were sought, and recommend remedial action as necessary
Instructing the Company’s advocates on cases where the plaintiff(s) need to go to the doctor(s) for a second medical examination
Review of and determining whether the outcome of court cases should be appealed or not
Assist in recovery of Company outlay from third parties
Advising on the adequacy of claims reserves, reviewing the files and placing the correct reserves for all legal claims
Review of Kenya Gazettes and Legal Notices and advising departments on changes that may be relevant to their functions
Ensuring timely processing of all legal claims
Ensuring the Company operates within the laid down regulations and guidelines as far as claims are concerned
Any other duties that may be assigned from time to time
Person Specifications
Academic Qualifications
Bachelors Degree in Law from a recognized University
Professional Qualifications
Advocate of the High Court of Kenya
A post graduate diploma in Law from the Kenya School of Law
Certified Public Secretary of Kenya (ICS)
Commissioner of Oaths
Valid membership of the Law Society of Kenya
Valid membership to the Institute of Certified Secretaries
Experience
Substantial post qualification professional experience of 10+ years, 5 of which must have been in progressively leadership roles
Successful experience leading negotiations on complex contracts and agreements
Demonstrable track-record producing effective and high-quality legal advice to departmental heads within a business
Proven and successful experience in creating departmental priorities that align strategic direction of the legal department and the overall business objectives
Proven experience in relationship management and a demonstrated ability to lead a legal team and develop talents that subsequently drive value across the business
