The ConsultancyThe consultancy falls within the framework of IDLO Somalia’s engagement in the “Joint Justice Programme”.
The Criminal Justice Expert (Serious Crimes) will work in collaboration with IDLO Somalia’s Country Office staff, the Office of the Chief Justice, the Attorney General Office and other Somali justice sector stakeholders including the Ministry of Justice.
IDLO is supporting the Judiciary of Somalia to develop 3 Serious Crimes Bench Books for the Somali Judiciary (including District courts, Regional courts, Appeal courts and the Supreme Court).
The Serious Crimes Bench Books will provide a reference for judges and prosecutors during criminal proceedings.
They will offer guidance on statutes, judicial trends and policy directions that are relevant in matters of money-laundering & combatting the financing of terrorism, violent extremism and sexual and gender-based violence.
The incumbent will report to the IDLO Country Director and work closely with the Field Program Manager and Program Coordinator.
The Consultancy will be provided over a period of 5 months from July 1, 2019 to November 30, 2019. The incumbent will be responsible for the implementation of the following activities and deliverables:
Develop 3 bench books on Serious Crimes (focusing on money-laundering, SGBV and violent extremism), which includes:
Engage in consultation meetings with government stakeholders and IDLO partners to collect input on the structure, design and content of the bench books;
Collect case studies from the Judiciary and Attorney General’s Office of Serious Crimes cases to include in the bench books;
Develop the bench books with research and feedback given during consultation meetings;
Organize a validation meeting to present the draft bench books to IDLO partners and government stakeholders for review;
Provide technical support during stakeholder consultations on the draft bench books.
Delivery Period: July – September 2019
Prior to initiation of this task undertake the IDLO online Training of Trainers (TOT) to familiarize with IDLO Training methodology and send the certificate of completion to IDLO (capacitydevelopment@idlo.int) before commencing the design of the trainings.
Conduct a 3-day training on ‘Adjudicating Serious Crimes in the Courtroom: Understanding Elements of a Crime’ for judges from the Benadir and regional Appeal Courts, building their capacity in handling Serious Crimes cases. The expert shall:
Develop a fact-pattern-based training manual based on the Serious Crimes bench books;
Conduct training and mentoring for selected judges over a 3 day period to improving their understanding of the elements of a crime (using fictitious cases involving money-laundering and combatting the financing of terrorism, violent extremism and sexual and gender based violence);
Prepare and
deliver pre-and post- training tests, for both trainings, to assess the level of increased capacity development;
Submit a trainer’s report with a description of the training, results and recommendation.
Delivery Period: September – October 2019
Conduct a 3-day training on trial advocacy skills (with a focus on violent extremism) for prosecutors, building their capacity in handling Serious Crimes cases. The expert shall:
Develop a training manual, based on a fictitious violent extremism case, that incorporates the Serious Crimes bench books;
Conduct training and mentoring for selected prosecutors over a 3 day period;
Prepare and deliver pre-and post- training tests, for both trainings, to assess the level of increased capacity development;
Submit a trainer’s report with a description of the training, results and recommendation.
Provide technical advice to IDLO staff during the delivery period as well as take part to meetings or relevant conferences/events related to the area of the consultancy, if requested.
Ideal Candidate Profile
Education and Work Experience
Advanced University degree in Law, with expertise on Criminal Justice;
Ten (or more) years’ work experience in prosecution, law enforcement or criminal justice reform;
Proven experience in training and mentoring justice actors;
Proven experience in developing bench books, manuals, training packages and other guides for the Judiciary;
Work experience in Somalia, or another post-conflict state, is highly desirable;
Advanced research experience is highly desirable.
Language skills
Fluency in written and spoken English;
Fluency in written and spoken Somali is highly desirable.
Specific Technical skills and competencies
Highly organized, with a problem-solving attitude;
Strong communication and interpersonal skills, and the ability to work in a multi-cultural environment;
Ability to work under pressure with tight deadlines, flexibility and an entrepreneurial spirit;
Keen sense of ethics, integrity and commitment to IDLO's mandate;
Good understanding of the Somali context is an asset.
